GENERAL PROVISIONS



Article 1. Status of the Academy of Sciences



Academy of Sciences is the highest state scientific organization of the Republic of Belarus which exercises the organization and coordination of fundamental and applied scientific research carried out by all subjects of scientific activities, conducting fundamental and applied scientific research, developments, organization, conduct and coordination of state scientific expertise; serves as a leading organization of the republic on scientific and methodological support of the development of informatization.

Academy of Sciences performs some functions of the republican body of state administration within the powers defined by the present Law, the Statute of the Academy of Sciences and other legislative acts to solve the tasks that are assigned to it.

Academy of Sciences submits to the President of the Republic of Belarus and is accountable to the Council of Ministers of the Republic of Belarus.

The status of the Academy of Sciences as a non-profit organization is established by the present Law, the Statute of the Academy of Sciences and other legislative acts.

The Statute of the Academy of Sciences is adopted by its General Meeting and approved by the President of the Republic of Belarus.



Article 2. Composition of the Academy of Sciences



Academy of Sciences brings together the full members (academicians), corresponding members of the Academy of Sciences, other members of the General Meeting of the Academy of Sciences, honorary and foreign members of the Academy of Sciences, as well as departments and regional branches of the Academy of Sciences, the staff of the Academy of Sciences, scientific organizations and other legal persons in its custody, employees of these organizations and legal persons.



Article 3. The main tasks of the Academy of Sciences



The main tasks of the Academy of Sciences are:

scientific support of economic, social and state-legal development of the Republic of Belarus, its culture, rational use and protection of the natural environment;

organization and coordination of fundamental and applied scientific research carried out by all subjects of scientific activities; conducting of fundamental and applied scientific research, developments on most important directions of natural sciences, engineering, humanities, social sciences and arts in order to obtain new knowledge about human, society, nature and artificial objects, increasing the scientific and technical, intellectual and spiritual potential of the Republic of Belarus;

implementation of scientific and methodological support for the organization of fundamental and applied research performed by all subjects of scientific activities;

organization, conduct and coordination of the state scientific expertise in the established order, scientific and methodological support of its organization;

implementation of the accreditation of scientific organizations jointly with the State Committee on Science and Technology of the Republic of Belarus;

determining and introduction for approving lists of priority directions of fundamental and applied scientific research of the Republic of Belarus in the procedure established by legislation;

identifying essentially new ways of scientific and technical progress, participation in the elaboration of recommendations on the use of achievements of domestic and world science into practice;

ensuring the development of science in the regions of the Republic of Belarus;

creating conditions for the development of scientific schools, training of scientists of higher qualification, improving of professional skill of scientists and specialists, including training in foreign scientific centers;

introduction of proposals for funding of scientific, scientific and technical, and innovative activities in the Republic of Belarus in the established order;

organization of carrying out monitoring of flora and geophysical monitoring;

implementation of the state scientific and technical expertise of proposals for the purchase of high technologies and expensive equipment abroad, the rights to use inventions, useful models, industrial designs, selection achievements at the expense of the republican budget;

control jointly with the State Committee on Science and Technology of the Republic of Belarus for the effective use of state funds allocated to finance fundamental and applied scientific research, as well as developments, in the procedure prescribed by the Academy of Sciences and State Committee on Science and Technology of the Republic of Belarus with regard to the requirements of acts of legislation.



Article 4. The main directions of activities of the Academy of Sciences



The main directions of activities of the Academy of Sciences are:

performing analysis of the state and implementation of forecasting trends in development of science and engineering, economy, social and legal spheres, the level of technologies;

development and approval of state programs of fundamental and applied scientific research, perspective and annual plans for most important scientific-research works in the Republic of Belarus and the organization of their implementation in the established order;

establishment of scientific and scientific and technical councils, committees, commissions on actual problems of natural sciences, technical, humanities and social sciences and arts;

introduction of proposals to improve legislation in the established order;

determining the main directions of activities of scientific institutions and other legal persons administered by the Academy of Sciences;

provision of training of scientific and scientific and pedagogical personnel of higher qualification;

conduct of fundamental, including oriented fundamental, and applied scientific research and developments;

analysis of the level of fundamental and applied scientific research and developments in scientific organizations and institutions providing higher education, preparation of proposals on increase of their efficiency;

approval jointly with the State Committee on Science and Technology of the Republic of Belarus compositions of the expert councils (commissions) created for carrying out the state scientific expertise and the state scientific and technical expertise;

carrying out scientific expertise of major projects of most important normative legal acts, scientific, scientific and technical and national economic programs, innovative projects in the established order;

taking measures to develop its own scientific and technical potential, to strengthen material and technical base of the Academy of Sciences, organization of pilot production of science intense and high-tech scientific and technical products, creation and dissemination of new methods and tools for the study of regularities, phenomena and processes;

development and presentation in the established order of the draft plans of financing and material and technical support of fundamental and applied scientific research and developments, as well as capital investments for the development of scientific organizations and other legal persons administered by the Academy of Sciences;

implementation of international scientific and scientific and technical cooperation, the development of mutually beneficial links with Academies of Sciences and other scientific organizations of foreign countries, the implementation of intergovernmental scientific and scientific and technical programs and projects, participation in activities of international scientific and scientific and technical organizations and associations;

promoting the scientific level of the national education system, participation in training of specialists with higher education and improving of professional skill of the teaching staff of institutions providing higher education;

participation in the promotion and dissemination of scientific knowledge;

creation of representations of the Academy of Sciences in the established order;

creation of scientific and scientific and production centers in the established order;

action as a founder of the commercial and non-commercial organizations, including scientific ones and those training scientists of higher qualifications, educational institutions with university status, as well as foundations;

participation in the activities of legal persons of other states in the established order;

creation its own resources and participation in the formation of state resources of scientific and technical information, its dissemination, including domestic and international information computer networks, development of proposals for legal, organizational and economic support of development of scientific and technical information system;

holding of scientific sessions, conferences, schools, seminars and meetings, as well as taking part in such events.



Article 5. Academic scientific ranks



Academy of Sciences has the right to assign the following academic scientific ranks:

Full Member (Academician) of Academy of Sciences;

Corresponding Member of Academy of Sciences.

Academic scientific ranks are assigned on the results of elections conducted in accordance with the Statute of the Academy of Sciences. Full members (academicians) and corresponding members of the Academy of Sciences, as well as pensioners having the mentioned scientific ranks are granted monthly surcharge for academic scientific ranks, the appointment and size of which are determined by legislation.

Only the full members (academicians) and corresponding members of the Academy of Sciences have the right to be called full members (academicians) and corresponding members without a specifying membership in a particular Academy of Sciences.



Article 6. Scientific Archives of the Academy of Sciences



In accordance with the legislation, the Academy of Sciences stores manuscripts of scientists, mans of literature, art and culture, as well as archival materials of scientific organizations and other legal persons administered by the Academy of Sciences which are valuable for the history of science in the Central Scientific Archive of the Academy of Sciences and the archives of scientific organizations under its authority.

Academy of Sciences submits information on the composition and content of documents of the Central Scientific Archive of the Academy of Sciences and the archives of scientific institutions under its authority to the relevant state bodies (organizations), to include information about them in the vault of the National Archive Fund of the Republic of Belarus.



Article 7. Publishing activity and printed editions of the Academy of Sciences



Academy of Science has the right to establish and publish scientific journals, newspapers and other publications, including those in electronic form, as well as to exchange publications with scientific organizations and institutions providing higher education, libraries and museums, international and foreign organizations in the order established by legislation.



Article 8. Interrelations of the Academy of Sciences with the state bodies and other organizations



Academy of Sciences is the subject of the state scientific and technical policy of the Republic of Belarus. Acts of legislation on matters of the development of science in the Republic of Belarus are adopted by agreement with the Academy of Sciences.

The activity of the Academy of Sciences is implemented on the basis of a combination of state regulation of scientific, scientific and technical, and innovative activities with the creative initiative of scientific teams, the freedom of scientific search in order to ensure the effective implementation of tasks facing to the Academy of Sciences.

In order to implement certain functions of the republican body of state administration on matters within its competence, the Academy of Sciences takes normative legal acts and supervises their implementation.

The state creates conditions necessary for the implementation of the tasks entrusted to the Academy of Sciences, contributes to the increase of the authority of the Academy of Sciences and its role in sustainable socio-economic and political development of the Republic of Belarus, finances its activities in the established order.

In its activities, the Academy of Sciences is actively cooperating with the republican bodies of state administration, other state bodies (organizations), including through the participation of authorized representatives of the Academy of Sciences in sessions of boards, scientific and scientific and technical councils, meetings held by these bodies (organizations) in considering issues within the competence of the Academy of Sciences.

Academy of Sciences has the right to go directly to ministries, other republican bodies of state administration, other state organizations subordinated to the Council of Ministers of the Republic of Belarus, and other organizations to receive replies to its requests.

Other aspects of the interrelationship of the Academy of Sciences with government bodies and other organizations are regulated by the Statute of the Academy of Sciences, other acts of legislation.



Article 9. The interrelationship of the Academy of Sciences with other subjects and participants of scientific, scientific and technical, and innovative activities



Academy of Sciences in accordance with the Statute of the Academy of Sciences, other acts of legislation cooperates on a mutually beneficial and equitable basis with individuals and legal persons, international and foreign organizations that carry out the conduct, support or practical implementation of scientific research and developments, including basing on activities of members of the Academy of Sciences, working in other organizations.

The main forms of cooperation of the Academy of Sciences with other subjects and participants of scientific, scientific and technical, and innovative activities are:

fulfilment of fundamental and applied scientific research and developments through joint programs, plans and projects, as well as organizing and conducting joint scientific and scientific and practical sessions, conferences, meetings, symposia, schools, seminars, exhibitions and other scientific-organizational activities;

participation of scientists and specialists of republican bodies of state administration, scientific organizations and institutions providing higher education in the work of the General Meeting of the Academy and its Presidium, as well as in the scientific and scientific and technical councils, committees and commissions created by the Academy of Sciences, scientific organizations and other legal persons under the authorities of the Academy of Sciences;

granting scientists and specialists of scientific organizations and institutions providing higher education the possibility of performing joint fundamental and applied scientific research and developments in scientific organizations, administered by the Academy of Sciences, with the use of their material and technical base and scientific equipment;

participation in the implementation of fundamental and applied scientific research and developments conducted by scientific organizations and institutions providing higher education, as well as in teaching and training of scientists of higher qualification in these scientific organizations and institutions providing higher education;

participation in scientific, scientific and technical, scientific and methodological councils, committees and commissions created by other scientific organizations, institutions providing higher education, republican bodies of state administration and other state organizations subordinated to the Council of Ministers of the Republic of Belarus;

publication of the results of scientific research by scientists from scientific organizations and institutions providing higher education, from the Republic of Belarus and foreign countries, in scientific journals of the Academy of Sciences;

other forms of cooperation in accordance with the legislation and the Statute of the Academy of Sciences.

Scientific organizations and institutions of the Republic of Belarus providing higher education have the right to nominate on the directions of its scientific activities candidates for the positions of full members (academicians) and corresponding members of Academy of Sciences on announced specialties in the order established by the Statute of the Academy of Sciences.

The Academy of Sciences has the right to request and obtain information on the state and results of fundamental and applied scientific research and developments from scientific organizations and institutions providing higher education, performing scientific research at the expense of the republican budget, and to inspect and assess in the established order the state and level of performed specified scientific research, effective use of funds allocated from the republican budget for these purposes.

For the coordination of the scientific research a network of scientific and expert councils (commissions) on the most important scientific, scientific and technical, and socio-economic problems is created at the Academy of Sciences, the regulations on which are approved by the Presidium of the Academy of Sciences.

The Academy of Sciences can establish and award prizes, medals, diplomas and other awards for outstanding scientific achievements and the best scientific works to scientists, students of institutions providing higher education jointly with other domestic, international and foreign scientific organizations, and also to establish special grants for young scientists and postgraduates of the Republic of Belarus.
